Terms and Conditions

These Terms and Conditions govern access to and use of the Only 50 website, mobile application and related digital services. Only 50 operates an online advertising and discovery platform through which users may submit, publish and discover advertisements for permitted products and services, communicate with advertisers, register as agents and use such other features as may be made available from time to time, including reminders and WhatsApp notifications.

These Terms and Conditions constitute a legally binding agreement between the person accessing or using the Platform and Only 50. They should be read together with the Privacy Policy, Cookie Notice, refund disclosures and any feature-specific terms or notices displayed on the Platform. If a person does not agree to these Terms and Conditions, that person must not create an account, submit an Advertisement, make a payment, register as an Agent or otherwise use a restricted Platform feature.

SECTION 01

1. Acceptance And Electronic Agreement

By accessing the Platform, creating or using an account, submitting or renewing an Advertisement, making a payment, registering or acting as an Agent, creating a Reminder, selecting a WhatsApp communication option or otherwise using a Platform feature, the User confirms that the User has read, understood and agreed to these Terms and Conditions and the documents incorporated by reference. Acceptance may be recorded through an electronic action, including selecting an acceptance box, submitting information, completing an OTP-based login or continuing with a transaction after the applicable terms have been presented.

General browsing of publicly available Advertisements may be permitted without account registration. Mere browsing will not be treated as consent to an unrelated processing purpose where Applicable Law requires a separate affirmative action.

SECTION 02

2. Definitions And Interpretation

2.1“Advertisement” means any listing, description, photograph, image, audio, video, price, contact information or other content submitted or proposed to be submitted for publication on the Platform in relation to a permitted product or service.

2.2“Advertiser” means a seller, service professional, business or other User who submits or seeks to submit an Advertisement for publication on the Platform.

2.3“Agent” means a person registered with Only 50 who introduces an eligible Advertisement to the Platform and may earn commission in accordance with these Terms and any applicable Agent terms.

2.4“Applicable Law” means any applicable statute, enactment, rule, regulation, notification, direction, order, judgment or governmental requirement having the force of law, as amended or replaced from time to time.

2.5“Buyer” means a User who views or responds to an Advertisement or independently seeks to acquire a product or service from an Advertiser.

2.6“Content” means any text, image, photograph, audio, video, document, logo, trade name, location, contact detail or other material submitted, displayed, transmitted or made available through the Platform.

2.7“Platform” means the Only 50 website, mobile application and related digital services, features and interfaces.

2.8“Reminder” means a task, meeting, birthday, anniversary, occasion, event or other matter entered by a User for which the User requests a notification through the Platform.

2.9“User” means any person who visits, accesses, registers on, submits information to or otherwise uses the Platform, including an Advertiser, Buyer, service professional or Agent.

Headings are for convenience and do not affect interpretation. The words “including” and “include” mean “including without limitation.” A reference to a law includes subordinate legislation and subsequent amendments. The singular includes the plural and vice versa where the context permits.

SECTION 03

3. Nature And Role Of The Platform

Only 50 provides technology for the publication, discovery and communication of Advertisements. Unless expressly stated otherwise, Only 50 does not own, manufacture, stock, inspect, authenticate, value, buy, sell, supply or deliver an advertised product or service; determine its price; act as the agent of a Buyer or Advertiser in their independent transaction; or assume possession, title or risk in relation to it.

Any communication, negotiation, inspection, payment, delivery, service engagement or transaction between Users is entered into independently and at their own responsibility. Only 50 is not a party to such transaction merely because an Advertisement was submitted, reviewed, approved, published, discovered or contacted through the Platform.

Only 50 does not provide escrow, custody, logistics, inspection, authentication, credit, insurance or buyer-protection services for transactions between Users. A payment facility made available through the Platform is used only to collect fees payable to Only 50 for Platform services unless the checkout page expressly states otherwise.

SECTION 04

4. Capacity To Use The Platform

The Platform may permit general browsing without prescribing a minimum age. A person who lacks legal capacity to enter into a binding contract or provide valid consent under Applicable Law must not independently create an account, submit an Advertisement, register as an Agent, purchase a paid feature or undertake a transaction requiring such capacity, and must act through a parent, lawful guardian or other lawfully authorised person where required.

A User acting for a business, association, family entity or another person represents that the User has authority to bind that person in relation to the relevant use of the Platform.

SECTION 05

5. Account Registration And Security

Certain features require an account and mobile-number verification through an OTP or another authentication method. The User must provide accurate, current and complete registration information and promptly update any information that changes. Only 50 may use an authorised third-party OTP provider to generate, deliver or verify an OTP.

The User is responsible for controlling access to the registered mobile number and device and for maintaining the confidentiality of OTPs and other authentication credentials. An OTP must not be disclosed to an unauthorised person. The User must promptly notify Only 50 of suspected unauthorised access, impersonation, loss of control over the registered mobile number or misuse of the account.

An account is personal to the registered User and must not be sold, transferred, rented or used to impersonate another person. Only 50 may request reasonable verification before changing account details, restoring access, processing a deletion request or acting on a sensitive instruction.

SECTION 06

6. User Representations And Duties

Each User represents that information and Content submitted through the Platform is authentic, accurate, complete to the extent reasonably required, not misleading, lawfully obtained and not submitted for an unlawful purpose. A User must not conceal material information, provide a false identity, impersonate another person or falsely represent any association, authority, qualification, licence, ownership or entitlement.

A User submitting information relating to another individual must be lawfully authorised to do so and must obtain any consent required under Applicable Law. Sensitive, confidential or excessive personal information must not be placed in a publicly visible field.

SECTION 07

7. Submission Of Advertisements

An Advertiser may submit an Advertisement containing the product or service name, category, description, condition, price, photographs, video or audio, locality or location, mobile or WhatsApp number, business information and other details reasonably required by the Platform. Submission does not create an entitlement to publication.

The Advertiser is solely responsible for the legality, accuracy, completeness and authenticity of the Advertisement; the advertised price and description; the right to offer, sell or provide the product or service; and the possession of all licences, registrations, approvals, permissions, intellectual-property rights and consents required for the Advertisement and the proposed transaction.

An Advertisement concerning a regulated occupation, product or service may be required to display or substantiate an applicable licence, registration, authorisation, warning, qualification, price disclosure or other information. Only 50 may restrict a category, impose category-specific conditions or decline publication where legal or operational requirements cannot be satisfactorily verified.

SECTION 08

8. Administrative Review And Approval

Each Advertisement may be subject to administrative review and will not necessarily become publicly available immediately after submission or payment. Authorised administrators may access the Advertisement, submitted media, account and contact information, payment status and other information reasonably required to assess the Advertisement.

Only 50 may approve, reject, return for correction, request clarification, restrict, suspend, disable or remove an Advertisement where it appears incomplete, inaccurate, misleading, unlawful, prohibited, fraudulent, unsafe, offensive, infringing, duplicative or inconsistent with these Terms, a Platform policy or Applicable Law. Only 50 may also act upon a complaint, legal notice, governmental direction, security concern or reasonable risk of harm.

Only 50 retains the discretion to decide whether to accept an Advertisement for publication, including where a category is unavailable, publication would conflict with its editorial or commercial standards, or the Platform lacks the capacity to support the proposed Advertisement. Submission or payment does not create an unconditional right to publication. Where a paid Advertisement is declined for reasons not attributable to the Advertiser's breach, any refund or other remedy will be governed by Section 14 and Applicable Law.

Payment of an Advertisement fee does not oblige Only 50 to publish Content that fails review or violates these Terms. Administrative approval permits publication on the Platform only and does not constitute verification, certification, endorsement or guarantee of the Advertiser, its identity, ownership, qualifications, legal capacity, product, service, price, quality, safety, authenticity or claims.

SECTION 09

9. Prohibited Advertisements And Content

A User must not submit, publish, transmit or promote Content involving an unlawful or prohibited product or service; stolen property; narcotic drugs or other illegal substances; counterfeit goods; forged or false documents; fraudulent financial, investment, employment or business schemes; pyramid or unlawful money-circulation schemes; obscene or sexually exploitative material; hate, threats or violence; defamation; impersonation; infringement of privacy or intellectual-property rights; malware; or any matter whose advertisement, possession, supply or promotion is prohibited by Applicable Law.

Unless expressly permitted by Only 50 after appropriate legal review, the Platform must not be used to advertise weapons, ammunition or explosives; narcotic or psychotropic substances; tobacco, vaping or intoxicating products; prescription medicines or unlawful medical claims; gambling, wagering or prohibited online games; human organs or biological material; sexual services; protected wildlife; government identification documents; bank accounts, payment instruments or unlawfully obtained data; recalled or unsafe goods; or any other restricted category identified in the Platform's publication standards.

Content must not be materially false or misleading, conceal an essential fact, manipulate a User into making a payment, misuse another person’s photograph or personal information, or create a false impression of approval, affiliation, scarcity, price, quality, result or guarantee. Only 50 may maintain and update more detailed publication standards, category restrictions or safety requirements on the Platform.

Where Content is synthetically generated, materially altered or created using artificial-intelligence tools, the User must make any declaration and apply any label required by the Platform or Applicable Law and must not use such Content to deceive, impersonate, defraud or mislead. Only 50 may request information reasonably necessary to verify such a declaration or label and may refuse or remove non-compliant Content.

SECTION 10

10. Public Information And User Contact

Information intentionally submitted for publication may become publicly accessible after approval. Depending on the fields selected by the Advertiser, this may include the Advertiser’s name, business or trade name, mobile or WhatsApp number, Advertisement description, images, price and locality. Users must review public fields carefully before submission.

Identity documents, Aadhaar information, private bank or settlement details, OTPs and internal verification records are not intended for public display. Reminder information is treated as private account information and will not be displayed in an Advertisement.

Public Content may be viewed, copied, photographed, downloaded, indexed, contacted or further shared by persons beyond Only 50’s reasonable control. Removal of an Advertisement from the Platform may not remove copies independently retained, indexed or circulated by third parties.

SECTION 11

11. Buyer Due Diligence And Direct Transactions

Before purchasing or engaging any product or service, a Buyer should independently verify the identity and credibility of the Advertiser, inspect the product or assess the service, review ownership and other relevant documents, confirm the price and terms, use a traceable and lawful payment method and exercise appropriate caution. Only 50 does not advise a Buyer to enter into a particular transaction merely because an Advertisement appears on the Platform.

Users are responsible for determining what additional information they disclose to one another and for documenting the terms of any independent transaction. Only 50 does not control communications, negotiations, inspections, payments, deliveries or transactions occurring through WhatsApp, telephone, in-person meetings or another external channel.

A User should not transfer money merely to reserve an advertised product, disclose an OTP, PIN or banking password, or rely on a payment request represented as being guaranteed by Only 50. Suspected impersonation, advance-fee fraud or misuse of the Platform’s name should be reported promptly through the grievance channel.

SECTION 12

12. Seller And Service Professional Responsibilities

An Advertiser offering a product must have lawful title, possession or authority to advertise and transfer it. An Advertiser offering a service must possess the qualifications, registrations, licences, permissions, insurance and professional authority required for that service, where applicable. The Advertiser must provide legally required disclosures, invoices, warranties or after-sales obligations directly to the Buyer and must not shift those responsibilities to Only 50.

The Advertiser remains responsible for fraud, misrepresentation, non-delivery, defective goods, deficient services, infringement, unlawful conduct and any tax or regulatory obligation arising from its independent business or transaction.

SECTION 13

13. Advertisement Fee And Payment

As at the Last Updated date, the fee for one Advertisement is ₹50 for a publication period of five months, subject to administrative approval and these Terms. The applicable fee, validity period and any tax will be displayed before payment. A change in pricing will apply prospectively and will not reduce a publication period already purchased, except where required by Applicable Law.

Payments are collected and verified through Razorpay or another payment processor identified at checkout. The payment processor may independently collect payment instrument, bank, UPI, card, billing, transaction and KYC information under its own terms and privacy policy. Only 50 does not intend to collect or store complete card numbers, CVV numbers, UPI PINs or banking passwords.

Razorpay is used to process fees payable to Only 50 for an Advertisement or another expressly identified Platform service. It is not a payment channel for the purchase price of a product or service advertised by a User, and Only 50 does not receive, hold or settle consideration exchanged independently between a Buyer and an Advertiser.

Successful payment does not guarantee immediate or automatic publication. The Advertisement will become eligible for publication only after the relevant payment is confirmed and the Advertisement is approved. Only 50 may issue an electronic acknowledgement, invoice, transaction reference or payment-status record.

SECTION 14

14. Refunds And Payment Errors

Except where required by Applicable Law or expressly stated on the Platform, an Advertisement fee is non-refundable after the Advertisement has been approved and made available for publication. No refund is due where an Advertisement is rejected, suspended or removed because the User supplied prohibited, unlawful, infringing, fraudulent, false or misleading Content or otherwise breached these Terms.

A User may request review of a duplicate charge, an amount debited because of a demonstrable technical error, or a successful payment for which the paid Advertisement service was not made available for reasons attributable to the Platform. Subject to verification, Only 50 may correct the payment status, restore the service, issue a Platform credit or process an appropriate refund. A refund will ordinarily be returned through the original payment channel and may be subject to the payment processor’s timelines.

Nothing in this section restricts a mandatory refund, chargeback right or consumer remedy that cannot lawfully be excluded.

SECTION 15

15. Validity Expiry And Renewal

An approved Advertisement will ordinarily remain eligible for public display for five months beginning on the date it is first published after approval, unless a different commencement date is clearly displayed before payment or the Advertisement is earlier removed, suspended or deleted under these Terms. The Platform may show the applicable start date, expiry date and status in the Advertiser’s account.

After expiry, the Advertisement may be removed from public display but may remain accessible within the Advertiser’s account to facilitate renewal or republication. Renewal is optional and requires payment of the fee displayed at that time and, where applicable, a fresh or updated administrative review. Renewal does not guarantee uninterrupted placement, ranking or visibility.

SECTION 16

16. Agent Registration And Verification

A person may register as an Agent only by providing the information and documents reasonably required by Only 50. This may include the Agent’s name, mobile number, address, photograph, business or professional information, a lawful identity document, Aadhaar information where lawfully permitted, bank or settlement details and tax information. Only 50 may request a masked Aadhaar or other limited identity information wherever practicable and does not independently carry out Aadhaar biometric authentication unless duly authorised under Applicable Law.

Agent identity information, Aadhaar details, bank information and internal verification records will remain private and will not be displayed to Platform Users. Such information may be used to verify the Agent, prevent impersonation and fraud, administer the Agent relationship and calculate, process, reconcile and evidence commission payments.

Registration does not create an employment, partnership, franchise, fiduciary or general agency relationship. An Agent is an independent participant with only the limited authority expressly conferred by the Platform or a written Agent agreement.

Only 50 may decide whether to accept an application to become an Agent and is under no obligation to appoint or continue to engage any applicant or Agent. It may decline, suspend or discontinue an Agent relationship for a lawful business, verification, compliance, security or performance reason, subject to Applicable Law, any executed Agent agreement and reconciliation of commission already earned under these Terms.

SECTION 17

17. Agent Commission

An eligible Agent may earn commission of ₹10 for each Advertisement validly attributed to that Agent where the Advertisement fee has been successfully paid, the Advertisement has satisfied administrative review and the Platform’s records establish the Agent’s eligibility. Commission is not payable merely because an Agent introduced a person, made an oral claim or submitted an incomplete, unpaid, rejected, cancelled, fraudulent or duplicate Advertisement.

Only 50’s system records, including the Agent code, Advertisement reference, registration record, date and time, payment status, approval status and other available digital evidence, will be the primary administrative basis for attribution and reconciliation. Where more than one Agent claims the same Advertisement, Only 50 may determine attribution in good faith from those records, subject to any non-excludable legal right.

Commission remains conditional and does not become finally payable until the relevant eligibility checks and reconciliation are completed. Commission may be withheld, adjusted or reversed where the underlying payment is reversed, refunded, charged back or found to be fraudulent, where attribution is duplicated or erroneous, or where the Agent breached these Terms. Applicable tax deduction, reporting or statutory withholding may be made. A change to the commission rate will operate prospectively after reasonable notice through the Platform or applicable Agent communication.

SECTION 18

18. Agent Conduct

An Agent may explain the Platform’s publicly stated services but must not make an unauthorised promise or guarantee, alter the official price, misrepresent approval or publication, collect an unauthorised amount, obtain an OTP, misuse personal information, impersonate Only 50 or bind Only 50 to a transaction. Unless expressly authorised in writing, payment of the Advertisement fee must be made through the official payment method made available by the Platform.

An Agent is personally responsible for fraud, misrepresentation, unauthorised collection, unlawful conduct or misuse of customer information committed by that Agent. Only 50 may suspend verification, commission or Agent access while investigating a complaint or suspected violation.

SECTION 19

19. Location Based Discovery

The Platform may request access to a User’s approximate or device location to display Advertisements relevant to the User’s area. Device-based location will be accessed only after the User grants the relevant permission through the browser, device or application settings. The User may decline or later disable that permission, although location-based results may then be unavailable, less accurate or based on a locality manually selected by the User.

A location or locality voluntarily included in an Advertisement may be publicly displayed. Users should avoid publishing an exact residential address unless it is necessary and intentionally meant for public display.

SECTION 20

20. Whatsapp And External Communication

Where a User selects an option to contact an Advertiser through WhatsApp, telephone or another external service, the Platform may redirect the User to that service using the contact information provided by the Advertiser. Communications after redirection are independently processed by the relevant service and are subject to its terms and privacy practices.

Only 50 does not ordinarily receive or store the contents of independent communications between Users outside the Platform unless those communications are subsequently submitted for support, investigation, complaint or dispute-resolution purposes.

SECTION 21

21. Reminders And Whatsapp Notifications

A User may voluntarily create a Reminder for a task, meeting, birthday, anniversary, occasion, event or other matter. The User is responsible for entering the correct content, date, time, recurrence, time zone, delivery number and other instructions and for keeping them updated. Reminder information is processed to create, schedule, manage and deliver the notification requested by the User.

By activating WhatsApp delivery, the User specifically requests and consents to transmission of the verified mobile number, Reminder message, scheduled-delivery information and limited technical instructions to WhatsApp and any authorised messaging provider engaged for delivery. Consent to a Reminder is not consent to unrelated advertising or promotional messages.

The User may edit, reschedule, pause, disable or delete a Reminder through available Platform controls. A cancellation may not stop a message already transmitted for delivery. Reminder delivery depends upon accurate User instructions, network connectivity, device settings, availability and policies of WhatsApp or another service provider and other factors outside Only 50’s reasonable control. Only 50 does not guarantee that a Reminder will be delivered at an exact time or at all.

The Reminder feature is a convenience service and must not be relied upon as the sole means of remembering an emergency, medical treatment, legal deadline, financial obligation, safety-critical task or other matter where delay or non-delivery may cause material harm. The User should maintain an independent record or alert for such matters.

A User must not enter sensitive, confidential, excessive or unlawful information or another individual’s personal information unless lawfully authorised. A location manually written in a Reminder does not, by itself, authorise continuous access to or tracking of the User’s device location.

SECTION 22

22. Privacy And Data Protection

The collection, use, storage, disclosure, retention and deletion of personal data in connection with the Platform are governed by the Privacy Policy and any specific notice or consent request presented when the data is collected. The Privacy Policy forms part of these Terms and should be reviewed before using an account, payment, Agent, location, communication or Reminder feature.

Where a User requests deletion of an account, pending and recurring Reminders associated solely with that account will ordinarily be cancelled and active Advertisements and the public profile may be removed or deactivated, subject to reasonable technical time and lawful retention for payment, accounting, taxation, cybersecurity, fraud prevention, complaints, disputes, enforcement and legal compliance.

SECTION 23

23. Third Party Services

The Platform may use, link to or integrate Razorpay, WhatsApp, an OTP provider, Hostinger, Google Analytics and other payment, communication, hosting, analytics, security or technical services. Access to or use of a third-party service is also governed by that service’s terms and privacy practices. Only 50 does not control a third party’s independent service availability, processing practices or acts, but this does not exclude a responsibility that Only 50 is legally required to assume.

SECTION 24

24. Platform Intellectual Property

The Platform and its software, databases, design, layout, text, graphics, logos, marks, interfaces, compilation and other proprietary material are owned by Only 50 or the relevant licensor and are protected under Applicable Law. Except for the limited right to access and use the Platform in accordance with these Terms, no intellectual-property right is transferred to a User.

A User must not copy, reproduce, modify, reverse engineer, scrape, frame, commercially exploit, distribute, create a derivative work from or use Only 50’s name, logo, software or proprietary Content without prior written permission, except to the extent such restriction is prohibited by Applicable Law.

SECTION 25

25. User Content And Publication Licence

The User retains ownership of Content lawfully owned by the User. By submitting Content for publication, the User grants Only 50 a non-exclusive, worldwide, royalty-free and sublicensable licence, for the period reasonably necessary to operate the Platform and the Advertisement, to host, store, reproduce, adapt for technical formatting, display, distribute and make the Content available through the Platform and its ordinary promotional or discovery interfaces.

This licence is limited to operating, securing, moderating, improving and promoting the Platform and the relevant Advertisement and does not transfer ownership of the User’s Content. The User represents that granting this licence does not infringe another person’s rights.

SECTION 26

26. Misuse And Security

A User must not attempt to hack, probe, disable, overload, disrupt or circumvent the Platform or its security controls; access another User’s account or restricted data; create a fraudulent or automated account; upload malware; scrape or harvest data without authority; send spam; manipulate search, ranking, payment, attribution or commission records; or use the Platform in a manner that threatens security, privacy, safety or lawful operation.

Only 50 may preserve relevant records, restrict access and report suspected unlawful activity to a competent authority where reasonably necessary or required by law.

SECTION 27

27. Complaints Notices And Takedown

A person may report an Advertisement, account or Content believed to be unlawful, fraudulent, misleading, infringing, unsafe or contrary to these Terms by providing sufficient information to identify the relevant material and explain the concern. A person asserting ownership or another legal right should provide reasonable supporting information and contact details.

Only 50 may seek clarification from the complainant or User, preserve relevant records, temporarily restrict Content during review, remove or disable access to Content, notify affected persons where appropriate, or comply with a lawful order, notice or direction. A User must cooperate reasonably with a genuine review and must not submit a knowingly false, frivolous or misleading complaint.

Complaints will be acknowledged within twenty-four hours and ordinarily resolved within seven days. Where Applicable Law prescribes a shorter period, Only 50 will act within that period, including, where legally applicable, resolving specified removal requests within thirty-six hours and taking reasonable and practicable measures within two hours on a qualifying complaint concerning non-consensual intimate material, nudity, a sexual act, impersonation or artificially morphed content. These timelines do not prevent immediate interim restriction where reasonably necessary to reduce harm or preserve legal compliance.

Where Content is restricted or removed other than pursuant to a binding legal direction, Only 50 may provide the affected User with reasons and a reasonable opportunity to seek review or reinstatement, where appropriate and legally permissible. Only 50 is not required to determine disputed title, authenticity, professional negligence or another contested civil issue that properly requires adjudication by a competent authority.

SECTION 28

28. Suspension Termination And Account Deletion

Only 50 may restrict, suspend or terminate an account, Agent status, commission access, Advertisement or Platform feature where the User breaches these Terms, provides false information, engages in fraud or unlawful activity, creates a security or safety risk, repeatedly attracts substantiated complaints, fails verification, misuses the Platform or where action is required by Applicable Law or a competent authority.

Where reasonable and legally permissible, Only 50 may provide notice or an opportunity to correct a remediable breach. Immediate action may be taken where delay may cause harm, facilitate fraud, compromise security, expose unlawful Content or violate a binding legal direction.

A User may request account deletion through the Platform controls or the contact details stated below. Deletion does not extinguish an accrued payment, commission, refund, complaint, indemnity, enforcement or legal obligation, and does not remove copies of public Content independently retained by third parties.

Registration information and associated records may be preserved for at least one hundred and eighty days after cancellation or withdrawal of registration where required under Applicable Law, and other records may be retained for the period reasonably necessary for payment, taxation, cybersecurity, fraud prevention, dispute resolution, legal claims or compliance with a lawful direction. Public access and internal lawful retention are separate matters.

SECTION 29

29. Platform Availability And Modifications

Only 50 may maintain, update, improve, modify, replace, restrict or discontinue a Platform feature. The Platform may be temporarily unavailable because of maintenance, technical failure, cybersecurity measures, network interruption, third-party service failure, force majeure or another operational reason. Only 50 will use reasonable efforts appropriate to the circumstances but does not guarantee continuous, error-free or uninterrupted availability.

Display position, search ranking, reach, views, enquiries, responses, sales or other commercial results are not guaranteed. Only 50 may alter technical specifications or publication standards prospectively where reasonably required for security, legal compliance, service quality or Platform operation.

SECTION 30

30. Disclaimers

To the extent permitted by Applicable Law, the Platform and all Advertisements are provided on an “as available” basis. Only 50 does not warrant that an Advertisement, Advertiser, Buyer, Agent, product, service, price, ownership claim, qualification, licence, document, communication or proposed transaction is genuine, suitable, safe, available, accurate or free from defect, fraud or infringement.

No information displayed or communicated by the Platform constitutes legal, financial, investment, medical, professional or purchasing advice. A User must make an independent assessment and obtain appropriate professional advice where necessary. Nothing in these Terms excludes a warranty, duty or remedy that cannot lawfully be excluded.

SECTION 31

31. Limitation Of Liability

To the maximum extent permitted by Applicable Law, Only 50 will not be liable for an indirect, incidental, special, exemplary or consequential loss, loss of profit, opportunity, goodwill, data or business, or for loss arising from an independent transaction between Users, the quality or delivery of an advertised product or service, unauthorised User conduct, inaccurate Content, a third-party service, Reminder delay or failure, or an event outside Only 50’s reasonable control.

Where liability cannot lawfully be excluded, Only 50’s liability will be limited only to the extent permitted by Applicable Law and having regard to the nature of the Platform service and the amount paid for the affected Platform feature. No provision limits liability for fraud or wilful misconduct by Only 50, or any statutory consumer or other right that cannot legally be limited.

SECTION 32

32. Indemnity

To the extent permitted by Applicable Law, a User will indemnify and hold Only 50 and its lawful representatives harmless from third-party claims, losses, liabilities, penalties, damages and reasonable legal costs arising from the User’s unlawful Content, infringement of another person’s rights, fraud, misrepresentation, unauthorised collection, independent transaction or material breach of these Terms. This obligation will not apply to the extent a claim results from Only 50’s own fraud, wilful misconduct or non-excludable legal responsibility.

SECTION 33

33. Electronic Communications

The User agrees that service-related notices, payment acknowledgements, approval or rejection communications, account alerts, complaint updates, changes to these Terms and other legally permissible communications may be provided electronically through the Platform, SMS, WhatsApp, email or the registered mobile number. Promotional communications will be sent only in accordance with Applicable Law and applicable consent or preference controls.

A notice is not invalid merely because it is delivered electronically where electronic delivery is legally permitted. The User is responsible for keeping the registered contact details current.

SECTION 34

34. Force Majeure

Only 50 will not be responsible for delay or failure caused by an event beyond its reasonable control, including natural disaster, epidemic, war, civil disturbance, governmental action, legal restriction, labour disruption, telecommunications or power failure, cyberattack, failure of a payment, hosting, messaging or network provider, or interruption of internet infrastructure. This provision does not excuse a payment or statutory obligation that has already accrued and cannot lawfully be avoided.

SECTION 35

35. Changes To These Terms

Only 50 may revise these Terms to reflect a change in Applicable Law, Platform functionality, pricing, commission, publication standards, third-party services, security measures or business operations. The revised Terms will state the date of the latest update and will be made available through the website or mobile application.

Where Applicable Law requires advance or specific notice of a material change, Only 50 will provide such notice. Continued use after the revised Terms become effective may constitute acceptance where legally valid; however, a change requiring fresh consent will not be imposed solely through continued use.

Only 50 may also periodically remind Users of the applicable rules, Privacy Policy, user agreement and consequences of non-compliance, at least as frequently as Applicable Law requires. Continued access may be suspended and non-compliant Content may be removed in accordance with these Terms and Applicable Law.

SECTION 36

36. Governing Law And Jurisdiction

These Terms and the use of the Platform are governed by the laws of India. To the extent a court at Patan, Gujarat has jurisdiction under Applicable Law, the courts at Patan shall have exclusive jurisdiction over civil proceedings arising from these Terms or the Platform. This choice of forum does not confer jurisdiction on a court that otherwise lacks it or exclude a consumer commission, statutory tribunal, appellate authority or other forum whose jurisdiction cannot lawfully be restricted by agreement.

Before commencing proceedings, the parties are encouraged, where appropriate, to attempt good-faith resolution through the grievance mechanism below. This does not prevent urgent interim relief or the exercise of a statutory right.

37. Grievance Redressal And Contact Information

Questions, complaints, reports, legal notices, refund requests and grievances concerning the Platform or these Terms may be submitted to the following contact. The complainant should provide sufficient information to identify the relevant account, Advertisement, transaction, payment, Content or processing activity and should not include unnecessary confidential information.

Only 50 may seek reasonable verification before acting upon a request that may affect an account, payment, personal data, Advertisement or legal right. The acknowledgement and resolution periods stated in Section 27 will apply subject to any different mandatory timeline. A person aggrieved by the Grievance Officer’s decision, or by non-resolution within the prescribed period, may use the Grievance Appellate Committee mechanism within the period allowed by Applicable Law and may pursue any other remedy available before a competent consumer authority, data protection authority, court, tribunal or forum having jurisdiction.

SECTION 38

38. Miscellaneous

These Terms, the Privacy Policy and other applicable Platform policies constitute the agreement governing use of the Platform. If a specific feature notice conflicts with these Terms, the more specific notice will govern that feature to the extent of the conflict. An Agent agreement, where executed, will additionally govern the Agent relationship.

If any provision is held invalid or unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will continue in effect. A failure or delay in exercising a right is not a waiver. The User may not assign an account or rights under these Terms without prior written permission. Only 50 may assign these Terms in connection with a lawful transfer or reorganisation of the Platform, subject to Applicable Law.

Provisions which by their nature are intended to survive expiry, suspension, account deletion or termination—including payment, commission reconciliation, intellectual property, public Content consequences, disclaimers, liability, indemnity, dispute resolution and lawful record retention—will survive to that extent.
